Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the QuakeWatch iOS application and related services (collectively, the “App”), provided by QuakeWatch (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

You must be able to form a binding contract to use the App and must comply with all applicable laws in your jurisdiction. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

QuakeWatch offers a free tier and an optional paid tier (“QuakeWatch Plus”) with additional features such as unlimited monitored locations. Subscriptions are billed through your Apple ID account in accordance with Apple’s App Store terms, and will automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your iOS device’s Settings.

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms;
• Attempt to interfere with, disrupt, or reverse-engineer the App or its underlying systems;
• Misrepresent your identity or your relationship to any other user when using family/friends features;
• Use the App to harass, stalk, or invade the privacy of another person;
• Access the App through automated means without our prior written consent.

Location and status sharing with contacts you add is voluntary and requires mutual consent. You are responsible for only connecting with people who have agreed to share their information with you. You may remove a connection at any time to stop future sharing.

The App aggregates seismic data from third-party scientific networks and public agencies. We do not control the accuracy, completeness, or timeliness of this underlying data and are not responsible for errors originating from these third-party sources.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE ACCURATE, TIMELY, UNINTERRUPTED, OR ERROR-FREE. WE DO NOT WARRANT THAT THE APP WILL DETECT, PREDICT, OR PROVIDE ADVANCE WARNING OF ANY EARTHQUAKE OR SEISMIC EVENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, QUAKEWATCH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF LIFE, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP — INCLUDING ANY DELAYED, MISSED, OR INACCURATE EARTHQUAKE ALERT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App and delete your account at any time.

We may revise these Terms from time to time. If we make material changes, we will provide reasonable notice through the App or other means before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which QuakeWatch is established, without regard to conflict-of-law principles, except where mandatory local consumer protection laws apply.
