Terms of Use

1. Acceptance of Terms

These Terms of Use are a binding agreement between you and the operator of BMI Calculator: Weight Tracker (“we,” “us,” or “our”). By downloading, accessing, or using the app or related services, you agree to these Terms and to our Privacy Policy.

If you do not agree to these Terms, do not use the app.

2. Eligibility

You must be legally able to enter into these Terms. The app is not intended for children under 13, or a higher minimum age if required by law in your location. If you use the app on behalf of another person, you are responsible for having authority to do so.

3. Description of the Service

BMI Calculator: Weight Tracker provides general wellness tools, including BMI calculation, weight tracking, food logging, AI food scanning, barcode scanning, calories and macros, water and activity tracking, Apple Health integration, progress charts, reminders, and related support features.

We may update, change, suspend, limit, or discontinue any feature at any time, subject to applicable law and any obligations associated with active subscriptions.

4. Health, Fitness, and Nutrition Disclaimer

The app is provided for general wellness, fitness, nutrition tracking, and informational purposes only. It is not a medical device, does not provide medical advice, and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

BMI, calorie, macro, activity, water, weight, and scanner outputs are estimates and may be inaccurate or incomplete. You should consult a qualified healthcare professional before making medical, diet, exercise, weight-loss, or health-related decisions, especially if you have a medical condition, are pregnant, are under medical care, or have specific dietary needs.

5. AI Food Scanner and Barcode Results

AI scanner and barcode results are provided as convenience tools. Food identification, serving-size detection, calorie estimates, macro estimates, and product information may be wrong, outdated, incomplete, or not applicable to your specific food or serving.

You are responsible for reviewing, correcting, and confirming any entry before relying on it. The app should not be used where an inaccurate nutrition estimate could create a safety risk.

6. Apple Health Integration

If you connect Apple Health, you authorize the app to read or write the HealthKit categories you approve in Apple's permission screen. You can revoke permissions at any time in the Health app or iOS Settings.

You agree not to intentionally enter false, misleading, or harmful data into the app for writing to Apple Health or other health-management services.

7. Accounts and Security

Some features may require an account or subscription. You agree to provide accurate information, keep your credentials secure, and notify us if you suspect unauthorized access. You are responsible for activity that occurs through your account.

8. Subscriptions, Billing, and Apple In-App Purchases

Certain features may require a paid subscription or in-app purchase. Purchases made through the Apple App Store are processed by Apple and are subject to Apple's payment terms, billing rules, and refund policies.

Unless otherwise disclosed at purchase, subscriptions automatically renew until canceled. You can manage or cancel subscriptions in your Apple Account settings. To avoid renewal, cancel at least 24 hours before the end of the current billing period, or as otherwise stated by Apple.

Subscription price, duration, renewal terms, trial terms, and included features are shown at the point of purchase. We may change subscription features or pricing as permitted by Apple and applicable law.

9. Refunds

For purchases made through Apple, refund requests are handled by Apple under Apple's applicable policies. We do not control Apple's refund decisions and cannot guarantee that a refund will be granted.

10. Apple App Store Terms

If you downloaded the app from the Apple App Store, Apple's Standard Licensed Application End User License Agreement also applies to your download and use of the app. If these Terms conflict with Apple's applicable App Store terms, Apple's terms control to the extent of the conflict.

11. Acceptable Use

You agree that you will not:

• Use the app in violation of any law, regulation, third-party right, or Apple policy.
• Reverse engineer, scrape, interfere with, overload, or attempt to access non-public portions of the app or services.
• Submit unlawful, harmful, misleading, infringing, or abusive content.
• Upload another person's personal, health, or image data without authorization.
• Attempt to bypass subscription controls, usage limits, safety systems, or security measures.
• Use the app to make emergency, medical, or time-sensitive decisions.

12. User Content and Data You Provide

You retain any rights you have in information, photos, notes, logs, entries, and other content you submit through the app (“User Content”). You grant us a limited, worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and use User Content solely to provide, maintain, secure, support, and improve the app and related services.

You represent that you have the rights and permissions necessary to submit User Content and that your User Content does not violate these Terms or any applicable law.

13. Intellectual Property

The app, website, software, branding, design, interfaces, features, text, graphics, and related materials are owned by us or our licensors and are protected by intellectual property and other laws. Except for the limited right to use the app under these Terms, no rights are granted by implication or otherwise.

14. Termination

You may stop using the app at any time. We may suspend or terminate access if we believe you violated these Terms, created risk, misused the service, or acted unlawfully. Termination does not automatically cancel subscriptions purchased through Apple; you must cancel those through your Apple Account settings.

15. Disclaimer of Warranties

To the maximum extent permitted by law, the app and related services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

16. Limitation of Liability

To the maximum extent permitted by law, we and our service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising from or related to your use of the app.

To the maximum extent permitted by law, our total liability for any claim related to the app will not exceed the greater of the amount you paid for the app or subscription in the 12 months before the event giving rise to the claim, or one hundred U.S. dollars (US$100).

17. Indemnification

You agree to indemnify and hold us harmless from claims, liabilities, damages, losses, and expenses arising out of or related to your User Content, your violation of these Terms, your misuse of the app, or your violation of any law or third-party right.

18. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice in the app, on the website, or by other reasonable means. Continued use after updated Terms become effective means you accept the updated Terms.

19. Governing Law

These Terms and any dispute arising from them are governed by the laws applicable in your jurisdiction of residence, unless applicable consumer protection law requires otherwise.
